DMCA & Copyright Policy

SoleSocial, a brand of Nexus Creative Group LLC, respects the intellectual property rights of others and expects our members to do the same. This policy is provided pursuant to the Digital Millennium Copyright Act of 1998 (“DMCA”) and describes how to report alleged copyright infringement.

If you believe your copyrighted work has been reproduced or displayed on SoleSocial without your authorization, please submit a written notification (a “DMCA Takedown Notice”) to our Designated Copyright Agent using the process below. We respond to properly-formed notices within 5 business days.

Our Designated Agent is registered with the U.S. Copyright Office pursuant to 17 U.S.C. § 512(c)(2).

2. What a valid Takedown Notice must include

Under 17 U.S.C. § 512(c)(3), your notice must contain all of the following. Notices missing any of these items will be returned for correction:

  1. A physical or electronic signature of the copyright owner (or authorized agent).
  2. Identification of the copyrighted work claimed to be infringed (a URL, registration number, or clear description).
  3. Identification of the material on SoleSocial claimed to be infringing — provide the specific URL of each page you want removed.
  4. Your full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

3. Our response process

  • Upon receipt of a valid notice we will disable access to the allegedly infringing material within 5 business days and notify the uploading member.
  • We will forward a copy of the notice to the uploading member with your name and contact information redacted for their initial notification. Full information will be shared if a counter-notice is filed.
  • Repeat infringers will have their accounts terminated pursuant to 17 U.S.C. § 512(i).

4. Counter-Notice procedure

If you are a member whose content was removed and you believe the removal was in error or the result of misidentification, you may file a Counter-Notice with our Designated Agent that includes:

  1. Your physical or electronic signature.
  2. Identification of the material removed and its former location (URL) on SoleSocial.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your full legal name, mailing address, telephone number, and email address.
  5. A statement consenting to the jurisdiction of the U.S. District Court for the judicial district in which your address is located (or, if outside the U.S., any judicial district in which SoleSocial may be found), and that you will accept service of process from the person who filed the original DMCA notice.

If we receive a valid counter-notice, we will forward it to the original claimant. Unless the claimant files a lawsuit within 10–14 business days, we will restore the removed material.

5. False Claims / Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that content is infringing (or that it was removed by mistake) may be liable for damages, including costs and attorneys’ fees. Please make sure you are the actual copyright owner or authorized to act on their behalf before submitting a notice.
